Welcome to our return policy for the Botika E-Shop (“Botika””).
Botika is an online store owned and operated by Alfred Gera & Sons Ltd (C 120) situated at 10, Triq il-Masġar Qormi, Malta (“AGSL”’; “we”; “us” or “our”).
It can be accessed through our website, http://www.botika.mt (the “Site”).
We are committed to making sure that your orders get to you in ship-shape condition and that you are satisfied with your purchase.
If you have changed your mind or are not completely satisfied with an item purchased online at Botika, you can return it to us within 14 days of receipt of item(s) to obtain a refund by following the steps outlined below. No exchange service is available in this case.
Returned items must be in their original packaging and condition, unopened and accompanied by the original invoice including all packaging with any related accessories and instruction booklets to be accepted as a return. No refund will be processed for items that are returned incomplete, damaged, or unsealed.
Please also note that, unless they are faulty, certain products such as food and drink items cannot be returned. We will indicate this to you if it applies to any of your orders.
Where a Return is due to a Faulty / Defective Product?
Where you order an item over Botika and, following its delivery, discover that it is faulty, defective or does not work as it should, you are entitled to ask for it to be replaced or else ask for a refund. This must be notified to us within 14 days of your receipt of the item. We will inspect the item on its return to us and, should we agree that there is a fault or defect, we will either exchange or refund it.
- HOW TO RETURN ITEMS [PROCEDURE]
(i) How to Return via Drop-off.
If you decide that your item should be returned, please email us on email@example.com with the following information:
- Subject line: Return of Item (insert order number);
- Image of the product in question;
- Reason for return;
- Confirmation that the products are in the same condition as delivered (e.g. still sealed).
- Inform us whether a refund or replacement is being requested.
Please include each item(s) in its original packaging materials, together with a copy of your invoice and any related accessories and instruction booklets as well.
You shall receive an e-mail notification upon the completion of the returns process.
We will prosecute to the fullest extent of the law any fraudulent activities, including without limitation, any attempt to reverse or seek a refund of a valid charge for an order that has been properly fulfilled and delivered to you and which is not subject to a right of return.

If the item is returned within its cooling-off period, we will refund you the original price paid (in the same currency as purchase) for the item, less any adjustments or credits that may have been subsequently issued (if any). In the case of faulty or defective items, the options include either a refund or a replacement. If a refund is chosen, it will be processed in the same manner, provided the item is returned within its guarantee period and we agree (following our inspection) that there is such a fault or defect.
All refunds will be credited to the original purchaser's form of payment unless otherwise specified on the returns form. The original purchaser's credit card account will be credited upon the processing of the returned item(s), and the credit should appear on the original purchaser's next bank statement.
Refunds of items purchased with a gift card will be issued in the form of another gift card. For all goods returned by the recipient of a gift, a virtual gift card of equivalent amount will be issued to their attention.

- CANCELLING YOUR ORDER
(i) Before your order has been dispatched:
Please note that once you place an order at Botika, there is a limited period of time during which you will be able to cancel your order until it is fully processed. If the cancel option is available, you will find a button next to your order.

(ii) After your order has been dispatched:
Under applicable distance selling legislation, you can also choose to cancel your order within fourteen (14) calendar days of receipt of your goods, without justification. If you choose this option, we will refund you the full price of any items returned in accordance with this Return Policy and the original/full delivery charges.
In the case of Malta, this right of withdrawal is currently found under the Consumer Rights Regulations, Subsidiary Legislation 378.17.
To cancel your order, you must clearly inform us of your decision to cancel by sending us an e-mail giving us details about the items ordered and their delivery date. You may also use model cancellation form provided below but it is not mandatory.
This cooling off period does not apply to:
- perishable goods such as food and drinks.
- personalised goods;
- goods which have been unsealed after delivery.

This Return Policy is governed by the laws of Malta. Nothing contained in it shall affect or deprive you of your statutory rights. For more information on your statutory rights, contact your local consumer authority.
